Workers Compensation Insurance Laws
1. What Florida businesses are
required to have Florida Workers Compensation Insurance?
Any Florida employer with four or more
full or part-time employees must provide workers' compensation
insurance.
If your company is in the construction
industry and you employ even one employee full or part-time you must
carry workers compensation insurance.
Florida State and local governments are
required to carry workers' compensation insurance.
Farmers (Agricultural engineers) who
have more than five regular employees and/or twelve or more additional
workers for seasonal agricultural labor lasting thirty (30) days or more
are also required to carry workers' compensation coverage.
2.
Can any Florida company get an exemption from covering their company
with Florida workers compensation Insurance?
Officers of Florida corporations
registered with the Florida Department of State, Division of
Corporations, can choose not be covered under the company's worker's
compensation plan. Proof of eligibility is required.
Construction industry corporate officers
- including LLC's can apply for an exemption from workers compensation
insurance requirements if the individual owns a minimum of 10% of the
corporate stock as evidenced by a Florida corporate stock certificate.
If your construction company is an LLC
you can show a notarized statement of 10% corporate ownership as proof.
